On February 13, Du Xueyi, director of the Economic Crime Procuratorate of the Supreme People's Procuratorate, revealed in an interview with the head of the Supreme People's Procuratorate that from January to November 2024, procuratorial organs across the country prosecuted a total of 5,064 tax-related crimes and 10,974 people, an increase of 29.6% and 38.1% year-on-year, respectively.
It is understood that in recent years, the Supreme People's Procuratorate has fully implemented the decisions and arrangements of the Party Central Committee, given full play to the role of procuratorial functions, and established a working mechanism for eight departments to jointly crack down on false tax fraud, strictly crack down on false tax fraud and other tax-related crimes, and continuously improve the quality and effectiveness of the crackdown. However, at present, the task of cracking down on tax-related crimes is still arduous, and we are facing many new situations and situations.
First, tax-related crimes are characterized by large-scale and chain-based crimes, and criminal methods are constantly evolving. Criminals have registered a large number of "shell companies", increasing the number of links and refining the division of labor, making the main body of the crime more dispersed, involving more enterprises and a wider range of regions.
Second, new forms of business and industry-related tax-related violations and crimes are prominent. The tax-related risks of new business formats such as cross-border e-commerce and live streaming have intensified, and the individual income tax supervision in the entertainment sector is facing new challenges.
Third, the characteristics of criminal professionalization are obvious. Major industrial and regional cases and cases of professional criminal gangs are frequent. Criminals take advantage of the differences in policies in different regions to "pay" for export tax rebates, government subsidies, and financial returns, resulting in huge losses in the state's fiscal revenue.
Fourth, false issuance, tax fraud, false settlement of foreign exchange, money laundering, smuggling, and so on, various crimes are intertwined, and the difficulty of cracking down has been further increased.
"It is an important political responsibility of the procuratorial organs to punish tax-related violations and crimes in accordance with the law and to safeguard the national tax system and political and economic security." Du Xueyi said that in the next step, the procuratorial organs will continue to strengthen departmental coordination and cooperation in terms of further highlighting the focus of the crackdown, unifying law enforcement and judicial standards, comprehensively and accurately implementing the criminal policy of blending leniency and severity, and strengthening administrative law enforcement and criminal justice cooperation, improve and improve the working mechanism, perform procuratorial duties in accordance with the law, and take the severe crackdown on tax-related crimes as an important political responsibility of the procuratorial organs to serve the overall development of the country, purify the business environment, ensure fiscal and tax security, and maintain economic order, and effectively provide a strong judicial guarantee for the high-quality development of the economy and society.
